Terms of Service

1. Scope

These Terms of Service govern your use of letsgoo.io, an AI-powered image generation platform operated by Foth Group GmbH. By registering an account, you confirm that you have read, understood, and agree to these terms.

2. Platform Purpose — AI Model Characters Only

letsgoo.io is exclusively designed for the creation of AI-generated fictional model characters. The platform allows creators to define a virtual model persona using reference images and generate content featuring that persona.

letsgoo.io is not intended for generating images of real people. By using the platform, you confirm that any reference images you upload represent an AI model character and not an identifiable real person without explicit consent.

3. Eligibility and Verification

You must be at least 18 years of age to use letsgoo.io. We verify your age through Stripe Identity before granting access. Providing false information during verification will result in immediate account termination.

To confirm your account represents an AI model creator, you are required to provide an Instagram handle for your AI model character. This handle will be manually reviewed to ensure it represents an AI-generated persona and not a real person's profile.

4. Subscription and Payment

After a 7-day free trial, letsgoo.io is available as a monthly subscription at €49.00/month (incl. 19% VAT). Billing is processed monthly in advance via Stripe. Your subscription renews automatically until cancelled. No refunds are provided for periods already paid, except where required by applicable law.

5. Cancellation

You may cancel your subscription at any time via the customer portal in your dashboard. Access continues until the end of the current billing period.

6. Prohibited Content

The following content is strictly prohibited on letsgoo.io. Automated systems and manual review are in place to detect violations:

• ✕Any content depicting or suggesting persons under 18 years of age — whether real or AI-generated, explicit or implicit.
• ✕AI model characters designed or described to appear younger than 18, regardless of any stated age.
• ✕Content featuring minor-adjacent props, settings or contexts (e.g. children's rooms, school settings as sexual context, toys associated with infants) combined with explicit material.
• ✕Sexualized or intimate images of real, identifiable people — including celebrities, public figures or private individuals — without their explicit consent.
• ✕Non-consensual intimate imagery (NCII) — including undressing, sexualizing or creating intimate depictions of real people.
• ✕Content depicting sexual violence, assault, coercion or non-consensual acts, even in a fictional context.
• ✕Content degrading or targeting individuals based on race, ethnicity, religion, gender identity, sexual orientation or disability.
• ✕Any content that constitutes child sexual abuse material (CSAM) or that could be used to facilitate harm to minors.

Violations of Section 6 may result in immediate account termination without refund.

7. Content Moderation

letsgoo.io employs automated content moderation on both text prompts and generated images. Prompts containing prohibited terms are blocked before generation. Generated images are screened for apparent minor age using AI-based analysis. Blocked content is never stored. Moderation incidents are logged for platform safety purposes.

8. Intellectual Property

You retain ownership of the reference images you upload. Generated images may be used for personal and commercial purposes, provided no third-party rights are infringed. letsgoo.io does not claim ownership over generated images. You may not use generated images in ways that violate applicable law or these Terms.

9. Privacy

We process your personal data in accordance with our Privacy Policy and applicable EU data protection law (GDPR). Age verification is performed by Stripe Identity — letsgoo.io only receives a confirmation of your verification status, never your identity documents.

10. EU AI Act Transparency

In accordance with Article 13 of the EU AI Act, letsgoo.io informs you that the images generated by this platform are produced using artificial intelligence. All generated content is AI-generated and does not constitute photography of real persons.

11. Limitation of Liability

Foth Group GmbH is not liable for damages arising from the use or inability to use the service. The platform is provided "as is" without warranty of uninterrupted availability. You are solely responsible for the prompts you submit and for ensuring your use complies with applicable law.

12. Account Suspension and Termination

We reserve the right to take the following graduated actions in response to violations of these Terms or applicable law:

• →Warning: a formal notice sent by email for minor or first-time violations.
• →Suspension: temporary restriction of access pending investigation or resolution of a violation.
• →Termination: permanent closure of the account for serious, repeated, or unresolved violations.

Violations of Section 6 (Prohibited Content) may result in immediate termination without prior warning. No refund is provided upon termination for cause.

13. Copyright and Takedown Procedure

If you believe that content on letsgoo.io infringes your copyright or other intellectual property rights, please send a written notice to:

Your notice must include: (1) identification of the copyrighted work claimed to be infringed; (2) identification of the allegedly infringing material and its location on the platform; (3) your contact information; (4) a statement that you have a good-faith belief that the use is not authorised; (5) a statement, under penalty of perjury, that the information in the notice is accurate and that you are the rights owner or authorised to act on their behalf.

We will review valid notices and take appropriate action, which may include removing the content and notifying the user concerned.

14. Indemnification

You agree to indemnify, defend, and hold harmless Foth Group GmbH and its officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the platform; (b) any content you submit, generate, or transmit through the platform; (c) your violation of these Terms; or (d) your violation of any applicable law or the rights of any third party.

15. Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be communicated by email. Continued use of the platform after changes constitutes acceptance of the updated Terms.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions shall continue in full force and effect.

17. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany. Place of jurisdiction is Berlin, Germany.
